California law defines “physical disability” broadly. A “physical disability” includes physical impairments: (a) that are actually and currently disabling; (b) that are potentially disabling; (c) that are perceived as disabling; or (d) that are perceived as potentially disabling.
In other words, even if you do not have an actual disability, if your employer discriminates against you because your employer incorrectly believes that you have a disability or believes that you will become disabled in the future, you may have a disability discrimination claim under California law.
